Welcome to munchmatch, operated by munchmatch, Inc. (”munchmatch," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the munchmatch mobile application platform ("the Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform. 

By using this application, you agree to the terms outlined in this End User License Agreement (EULA). This agreement grants you a non-exclusive, non-transferable license to use the app in compliance with all applicable laws and regulations. We maintain a strict no-tolerance policy for objectionable content and abusive behaviour. Any content deemed offensive, harmful, or inappropriate, as well as any abusive actions towards other users or our staff, will result in immediate termination of your access to the app. We reserve the right to remove any content and take appropriate action against users who violate these terms. Your continued use of the app constitutes acceptance of these conditions and a commitment to maintain a respectful and safe environment for all users.

 

1. Use of the Platform

a. Eligibility: You must be at least 18 years old and have the legal capacity to enter into a contract to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

b. Account Registration: You may need to create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary to keep it accurate, current, and complete.

c. User Conduct: You agree to use the Platform in compliance with all applicable laws, regulations, and these Terms. You further agree not to:

i. Use the Platform for any unlawful purpose or in violation of these Terms;

ii. Impersonate any person or entity, or falsely state or otherwise misrepresent yourself;

iii. Engage in any activity that interferes with or disrupts the functioning of the Platform;

iv. Harvest or collect information about other Users without their consent; or

v. Transmit any viruses, malware, or other harmful code through the Platform.

 

2. Content on the Platform

a. User Content: You are solely responsible for any content, including messages, photos, and other materials, that you upload, post, or transmit through the Platform ("User Content"). By submitting User Content, you grant munchmatch a worldwide, nonexclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation of the Platform.

b. Prohibited Content: You agree not to submit any User Content that is unlawful, defamatory, obscene, offensive, or otherwise objectionable, or that infringes upon the rights of any third party.

 

3. Meeting Matches

a. Public Venue Meetings: munchmatch facilitates connections between Users for the purpose of meeting at public venues. Any subsequent interactions or activities between Users at public venues are solely at their own discretion and risk.

b. Safety Precautions: While using the Platform, Users should exercise caution and common sense, and take appropriate safety precautions when meeting matches in person, including meeting in public places and informing a trusted friend or family member of their plans.

c. Once the booking is made through the Platform, any changes on the booking due to availability within the venue, changes made by either the venue or the Users, or any other modifications, cancellations, or additions to it, will be solely handled between the Users and the venue, and withdraw any responsibility from munchmatch.

 

4. Termination

We reserve the right to suspend or terminate your access to the Platform at any time and for any reason, without prior notice or liability.

 

5. Disclaimer of Warranties

The platform is provided on an “as is” and “as is available” basis, without any warranties of any kind, either express or implied. munchmatch disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

6. Limitation of Liability

In no event shall munchmatch or its officers, directors, employees, or agents be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if munchmatch has been advised of the possibility of such damages.

 

7. Indemnification

You agree to indemnify, defend, and hold harmless munchmatch and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Platform or any violation of these Terms.

 

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in the United Arab Emirates, and you hereby consent to the personal jurisdiction of such courts.

 

9. Changes to these Terms

We reserve the right to modify or revise these Terms at any time, and such changes will be effective immediately upon posting the revised Terms on the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
